Terms & Conditions for Participation

1. Organization of the Contest

DXOMARK IMAGE LABS, hereinafter referred to as “DXOMARK”, a company located at 24-26 quai Alphonse Le Gallo in Boulogne Billancourt, France, organizes from Thursday, September 22, 2022, 3:00PM   (Central European Time) through  Tuesday, October 4,  2022,  6:00 PM included, a contest called “Guess the iPhone 14 Pro Max Battery Score”, hereinafter referred to as “the Contest”, which is accessible exclusively on the DXOMARK Account https://www.instagram.com/dxomark/.
The game is free of charge with no obligation to buy.

2. Participation in the Contest

Participation in the Contest is open to anyone (hereinafter the “Participant(s)”) who, on the date the Contest begins, meets the following cumulative conditions:
– Be of legal age in his/her country
– Not be a resident of the following countries: Iran, Afghanistan, Central African Republic, The Republic Democratic Republic of the Congo, Democratic People’s Republic of Korea, Libya, Mali, Somalia, Sudan, Yemen.
– Have internet access (fixed or mobile);
– Have an account in his/her name on the Instagram social network
– Be a subscriber or subscribe to DXOMARK’s Instagram account

Participation in  the Contest is strictly personal, limited to one physical person (same name, first name and address) and per Instagram account on the social network and entails the pure and simple acceptance of the present rules in all of its provisions, of the rules of ethics in force (charter of good conduct, respect of good morals, etc.), as well as the laws and regulations applicable to games and contests in force in France.

The following are excluded from participating in this Contest:
– Minors
– DXOMARK personnel

Any false declaration by a Participant will result in his/her exclusion from the Contest and the non-award of any prize he/she may have won, as well as the invalidation of his/her participation, without DXOMARK being held responsible. DXOMARK reserves the right to proceed with any useful verification concerning the identity and domicile of the Participants. Any false, erroneous or incomplete indication of identity or address will result in immediate elimination from the Contest. Responses received after the deadline indicated above will be automatically eliminated.

3. Terms and conditions of the Contest

The Contest is accessible on the Instagram account of DXOMARK: https://www.instagram.com/dxomark/.
Participation in any other form or by any other means, in particular by post, will not be taken into account.
To participate in the game, the Participant must, between  September 22, 2022,  3:00PM (CET) and October 4, 2022 6:00 PM inclusive – date and time of connection in metropolitan France being taken as proof.
• To participate in the game, the Participant must connect to DXOMARK’s Instagram account between September 22, 2022,  3:00PM (CET) and October 4, 2022 6:00 PM (CET)  inclusive  and do the following: Follow @DXOMARK, (if not already a follower)
• Tag a friend
• Leave a comment with a numerical prediction of the Apple iPhone 14 Pro Max Battery score, based on the remapped scores.

Only one entry per person/Paricipant is allowed.  In the event that the same Participant publishes two guesses in the comments, the score that will be taken into account will be the first one published.
Each Participant is required to participate on their own behalf;  Participants may not  play under the name of another person, and  the winner may be asked to provide proof of identityto receive the prize. It is forbidden for the same person to participate via several different identifiers. It is forbidden to use an automated participation method.
DXOMARK is the only institution/entity authorized to validate or not the Participants’ entries.
Any profile in violation of the Rules will be nullified from  participation, and the Participant concerned will not be eligible to win one of the prizes offered in the framework of the Contest.
All participation must be fair: It is strictly forbidden, by any means whatsoever, to modify or attempt to modify the Game-Contest features offered, in particular in order to modify the results.

4. Designation of the winner and awarding of the prize
The Participants who have subscribed to DXOMARK’s Instagram account, who have answered the question of the contest and who have identified themselves on DXOMARK’s Instagram account  will be taken into account.
In the event that more than one participant has given the correct answer, a random draw will be held to designate the winners of the contest.
The Winners will be determined  and announced on October 7, 2022, by 6PM (CET) among the database of participants having found the right answer to the DXOMARK question and meeting the eligibility criteria of the contest.

The designated Winners will win the prize defined in article 5 of the present rules.
DXOMARK will inform the winner within  seven working days, with working days defined as Monday through Friday.. The winner thus contacted and identified in the publication will then have to confirm within seven  days,  via  private message to the DXOMARK account, that he/she accepts his/her prize, and will have to provide an email address to organize the delivery of the prize. The winner’s failure to reply within the above-mentioned conditions and timeframe will be deemed to be arenunciation of the prize, which may in no case be claimed at a later date. This prize will then be awarded to another Participant who will have been chosen as an alternate and who will be informed under the same conditions as those mentioned above, no later than the first business day following the expiration of the response period granted to the alternate Winner. For all intents and purposes, it is specified that Participants who are not winners will not be informed.

5. Description, value and awarding of prizes
Within the framework of the Contest, DXOMARK offers the following prize to the Participants
1 Apple iPhone 14 Pro Max, 128 GB
This  prize cannot be exchanged, transferred, or exchanged for any other object of any nature whatsoever.
The winner will have to confirm his or her acceptance of the  prize  via  private message within 7 working days..
In case of force majeure or in case of exceptional circumstances beyond its control, DXOMARK reserves the right to replace the prize  with a  prize  that is  equivalent in nature and/or  commercial value.

7. Connection and use
Participation implies knowledge and acceptance of the characteristics and limits of the Internet, the lack of protection of certain data against possible misappropriation or piracy and risks of contamination by possible viruses circulating on the network.
DXOMARK declines all responsibility in case of misuse or incident related to the use of the computer, access to the Internet, maintenance or malfunction of the Game-Contest servers, telephone line or any other technical connection.

8. Disputes and Liability
DXOMARK shall not be held responsible if for reasons beyond its control, the operation should be modified, postponed, cancelled partially or totally. If circumstances require, DXOMARK reserves the right to replace a prize with another prize of at least equivalent commercial value.
Participation in the Contest implies full acceptance of these rules and regulations in their entirety, in the version in effect at the time of participation. No dispute relating thereto will be accepted. All cases not provided for in these rules will be decided by DXOMARK whose decisions will be final. If one or more provisions of these rules are declared null and void or inapplicable, the other provisions shall retain their full force and scope.
Any inaccurate or misleading statement, any fraud will result in the immediate disqualification of the Participant. No telephone or written request concerning the interpretation or application of these rules, the mechanisms or terms of the Contest or the list of winners will be answered.
In case of dispute, only a registered letter with acknowledgement of receipt will be admissible within a maximum of one (1) month after the proclamation of the results, stating the reasons for the dispute. DXOMARK reserves the right, if circumstances so require, to shorten, extend, modify or cancel this Contest.

7. Jurisdiction
The Participants are subject to the French regulations applicable to games and contests. Any dispute arising from the interpretation and/or execution of these General Rules shall be submitted, failing amicable resolution, to the competent courts in accordance with the provisions of the French Code of Civil Procedure.

8. Data processing and freedom of information
The personal information collected in the context of this Game is processed in accordance with the French Data Protection Act of 6 January 1978 and the General Data Protection Regulation (RGPD). It is intended exclusively for the running of the Game and in particular for the taking into account of the participation and the awarding of prizes to the winners.
It is exclusively intended for DXOMARK in the context of the Game and will not be used for any other purpose. They will be kept for the time necessary for the management of the Contest, i.e. 1 month from the date of the prize-giving.
All Participants in the Contest have the right to access, modify, rectify and delete their personal data, in accordance with Article 27 of this law.
Any request for access, modification, rectification and deletion must be addressed to the data protection officer at the following address: email address.
In the event of a complaint that cannot be resolved directly with Inrap, Participants may contact the CNIL (https://www.cnil.fr/fr/plaintes).
